Eros O. Baldisserotto was employed by the Port of Moses Lake. On June 16, 1971, his employment was terminated. Thereafter, he applied to the Employment Security Department for unemployment compensation. His application was denied. After exhausting his administrative remedies to no avail, he appealed to the Superior Court for Grant County where the denial was affirmed. This appeal followed.
The facts are not in dispute. The Port of Moses Lake is a political subdivision of the State of Washington. RCW 53.04 . The port contracted with the United States to furnish supplies and services necessary to maintain certain housing units at the former Larson Air Force Base. Baldisserotto was employed by the port as a maintenance mechanic in the performance of that contract.
The port's obligation to make contributions to the employment security fund on behalf of its employees is governed by RCW 50.04.200 :
The term "employment" shall not include service performed in the employ of any political subdivision of this state or of any instrumentality of a political subdivision:
