STATE OF RHODE
ISLAND AND PROVIDENCE PLANTATIONS
PROVIDENCE, SC DISTRICT COURT, SIXTH DIVISION
RONALD
COTOIA :
V. : A.A. 05-46
DEPARTMENT OF LABOR AND TRAINING, BOARD OF REVIEW :
D E C I S I O N
MOORE, J. This
matter is before the Court on an appeal by the employee from a decision by the
Board of Review denying benefits. The Director and the Referee also denied benefits.
This Court affirms that decision.
Mr. Cotoia was an employee of Andon Electronics for a period of eight years.
He was discharged following an incident where he refused to work in production
and insisted in remaining in the stamping department. The Board of Review found
that this was misconduct, pursuant to G.L.R.I. 28-44-18, and that the employee
was discharged under disqualifying circumstances. This Court agrees with that
analysis.
In written documents filed with the Court, Mr. Cotoia claims that he was fired
for reasons relating to his medical condition. There is a complete absence of
any evidence of that in the record. This Court has a limited scope of review
pursuant to G.L.R.I. 42-35-15(g).
JUDGMENT
This cause came on before Moore, J. on Administrative Appeal, and upon review
of the record and a decision having been rendered, it is
ORDERED AND ADJUDGED
The decision of the Board is hereby affirmed.
